This section explains how we handle information connected to our text message program, ClearPath AI account notifications (the "SMS Program"). The SMS Program is optional. It is governed by our SMS Terms (see Terms of Service, section 22) and by the rest of this Privacy Policy. If anything in this Privacy Policy conflicts with this section, this section controls for SMS Program information.
What the SMS Program is for: We send account and transactional text messages only, about the Services you use with us: project status and milestones, meeting reminders, invoices and payment notices, and replies to your support requests. We do not send marketing or promotional text messages.
Information we collect for the SMS Program:
• Your mobile phone number
• Your consent record: the date and time you opted in, where you opted in (for example, our SMS opt-in page or your client portal settings), the wording you agreed to and its version, and the IP address and browser information used when you opted in
• Your opt-out and opt-in history, including STOP, HELP, and START replies
• Message records: the messages we send you and messages you send to us, with date, time, and delivery status
How we use it: We use SMS Program information only to:
• Send the account and transactional notifications you asked for
• Respond to your HELP requests and support messages
• Honor your opt-out and keep you on our do-not-text list after you opt out
• Keep a record of your consent and opt-out
• Protect against fraud and misuse, and meet legal obligations
We do not use your mobile number or SMS consent for marketing, advertising, or profiling.
Mobile information sharing: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All text messaging originator opt-in data and consent will not be shared with any third parties. Information sharing with subcontractors that support our services, such as the text message delivery provider that sends messages on our behalf, is permitted; those providers may use it only to deliver messages for us. We do not sell, rent, or trade your mobile number or SMS consent.
How long we keep it:
• Your mobile number and SMS preferences: while you are enrolled in the SMS Program and have an account with us
• Consent and opt-out records: while you are enrolled and for 4 years after you opt out or after our last message to you, so we can show that you consented and that we honored your opt-out
• Message records: 24 months after the message is sent
After opting out, we keep your mobile number on a do-not-text list so we don't text you again. Our general deletion practice in "4. Data Security" applies except where we must keep these records as described here or as required by law.
Opting out: Reply STOP to any message to stop all texts from the SMS Program. We will send one final message confirming that you have opted out, and then we will stop. You can also opt out by emailing admin@clearpathai.solutions or calling (347) 638-6781. Reply HELP for help. Opting out of texts does not affect emails about your account.
Message frequency and costs: Message frequency varies (up to 4 msgs/month). Msg & data rates may apply. Carriers are not liable for delayed or undelivered messages.
Consent is optional: Consent to receive text messages is not a condition of purchase or of using any of our Services.
